Compliance with Emissions Rule 6-5 NOW. PBF must provide continuous, public proof of compliance with Rule 6-5 per the settlement agreement reached with BAAQMD. Lack of compliance at any time should be considered a breach of the settlement agreement and mandate the installation of a wet gas scrubber.
Lawsuit Dismissal and Compensation: PBF must withdraw its lawsuit against the Bay Area Air Quality Management District (BAAQMD) and cover BAAQMD’s legal expenses. DONE!
Independent Air Monitoring Systems: PBF must finance the installation and ongoing maintenance of state-of-the-art, independent air monitoring systems within the community, including speciated particulate monitoring. BAAQMD to oversee all systems, provide interpretation of the data and violation enforcement.
Enhanced Public Communication: PBF must improve transparency now, which includes providing timely incident notifications and unrestricted access to raw fenceline and stack opacity data. PBF must also share all information regarding equipment inspections and maintenance schedules.
Reimbursement for Damages: PBF must compensate residents, the city, and the county for all damages including but not limited to physical and mental health, and loss of property values.
